School Disciplinary Tribunal Hearings

The Disciplinary Tribunal Hearing Process

If a student is accused of violating the school Code of Conduct and the principal of the school determines that a suspension of 10 days or more, or an expulsion from school is appropriate, a disciplinary tribunal hearing may be requested.

Violations of a school’s Code of Conduct include an alleged act of physical violence, assault or battery upon the person of any school employee (teachers, administrators, bus drivers and maintenance staff) or vandalism of school property or the property of a school employee.

A parent or guardian of the student must request a disciplinary tribunal hearing. After the disciplinary tribunal hearing is requested, the superintendent of the school will send a letter detailing the list of charges against the student as well as the date, time and location of the hearing.

During a school tribunal hearing, a tribunal panel consisting of three administrators or administrative assistants from the school system is formed. The tribunal hears evidence and determines whether the Code of Conduct was violated and if so, determines an appropriate punishment.

Finally, any decision reached by the tribunal may be appealed to the respective County’s Board of Education within 20 calendar days of the decision.
